Spodly.com Download and Fair Usage Policy
This policy is designed to ensure the secure, fair, and orderly access to all digital products (Templates, Plugins, Design Assets) purchased from Spodly.com. By completing a purchase, the User automatically agrees to abide by all the terms outlined herein.
1. Exclusive Link Ownership and Distribution
All download links provided to the User are unique, tracked, and non-transferable, regardless of the underlying product license (e.g., GPL).
- Strict Non-Sharing Rule: The User is strictly prohibited from sharing, publishing, redistributing, or allowing any third party access to their specific download links or associated credentials under any circumstances.
- Link Security: Download links are uniquely generated for the purchasing account and contain tracking codes.
- Consequences of Violation: Any confirmed attempt to share or publicly distribute a download link will constitute a severe breach of this policy, resulting in the immediate and permanent revocation of the link and potential termination of the User’s account without refund.
2. Download Quotas and Management
Access to product files is governed by a predefined download quota system managed within the User’s account dashboard.
A. Download Quota Types
| Quota Type | Description | Key Constraint |
| Annual Downloads | A limited number of successful downloads permitted within a 12-month period (e.g., 5 to 20 downloads). | Once the quota is exhausted, the download link will be automatically hidden from the User dashboard until renewal. |
| Lifetime Downloads | A perpetual quota which may start with a specific number (e.g., 20) and may reach an “unlimited” capacity. | Always subject to the Fair Usage Policy (Section 4), even if listed as “unlimited.” |
B. Quota Tracking and Calculation
- Quota Visibility: The User Dashboard will clearly display the remaining available downloads for each purchased product.
- Successful Downloads Only: Only successful download attempts (where the file transfer begins successfully from the Spodly.com server) will be deducted from the User’s quota. Failed attempts that do not successfully initiate a transfer will not be counted.
- Updates: Downloading product updates consumes one unit from the available quota.
3. User Responsibility for Download Process
The User is solely responsible for the method and tools used to download the files.
- External Download Managers: The use of external download managers or third-party software is at the User’s own risk. Any connection attempt initiated by such tools that successfully triggers the download process on our server will be counted as a successful download and deducted from the quota, regardless of whether the User completes the file download.
- Connection Interruptions: If a download is interrupted due to the User’s connection instability, any subsequent attempt to restart or resume the download will be treated as a new, successful download and will count against the available quota.
4. Fair Usage Policy (FUP)
This FUP applies strictly to all download links, particularly those designated as “Lifetime” or “Unlimited,” to prevent resource abuse.
Purpose: The FUP defines an acceptable and rational download pattern consistent with a single, legitimate user’s non-commercial needs.
Monitoring and Detection: Spodly.com reserves the right to continuously monitor download activity. Excessive or automated downloads (e.g., downloading the same file multiple times in a short, non-logical period) that significantly exceed typical personal use thresholds will be flagged as a violation.
Actions for FUP Violation: Should a violation of the Fair Usage Policy be confirmed, Spodly.com will take the following actions immediately:
- Immediate and Permanent Suspension of the offending download link(s).
- Account Suspension or Termination for repeat or egregious violations, resulting in the loss of all purchased products and access without refund.
